Part 2: Risk and Liability - Vapor Intrusion Mitigation and Managing Liabilities

  • Similar to PFAS as an “emerging contaminant,” VI was an “emerging pathway” in the early to mid-2000s

  • What have we learned since: a patchwork of state regulations

  • For transactions and industry, the driver is exposure risk rather than liability and specific regulations

  • VI risk evaluation is still evolving (TCE, maybe PFAS?)

  • Immediate investigation/mitigation can facilitate operations or transactions, but mitigation must also endure 5-10+ years to provide long-term viability

Emerging Contaminants Lead, RPS Ocean Science
Ms. Robinson excels in the evaluation of chemical fate and transport processes for exposure reconstruction and spill modeling, particularly related to large-scale chemical releases with multi-media impacts and emerging contaminants. Using these skills, she provides support to clients wishing to evaluate matters related to ecological, occupational, and public health. She estimates release impacts and exposure concerns through reconstruction of historical industrial practices, environmental data interpretation, and modeling spills in coastal and in-land environments. Ms. Robinson has provided litigation support for toxic tort, site contamination, and CERCLA lawsuits that span across many industries and mixed contaminants. Ms. Robinson’s strong analytical background in hydrologic modeling allows her to tackle complex issues in fate and transport.

Mr. Leitz has almost 25 years of experience in the environmental field overseeing site investigation and remediation of soil, soil gas, and groundwater for industrial, commercial, municipal and residential clients. Mr. Leitz draws on this deep experience to generate liability estimates related to acquisitions of facilities with operations with suspected or known VI concerns and advising on appropriate mitigations. These VI evaluations are designed to provide realistic liability profiles that can be used to guide facility operations or acquisitions in both the short and long term. Eric has spent several years working with clients on sites with known or potential Emerging Contaminants concerns, such as 1,4-dioxane and more recently PFAS. As part of that experience, Mr. Leitz has supported numerous clients by providing liability estimates related to acquisitions of facilities with operations with suspected or known emerging contaminant concerns.
